1. Introductory Provisions

These terms and conditions govern the purchase of products and services on the website www.senik.si and define the rights and obligations between SENIK (hereinafter: “the Seller”) and the buyer (hereinafter: “the Buyer”). These Terms and Conditions have been drafted in accordance with applicable law, including legislation on consumer protection, personal data protection, and e-commerce.

3. Ordering Custom-Made Products

To place an order, you must fill out the online form on the website. After filling out the form, a sales representative will call you to discuss which piece or pieces of furniture you would like to order. At this stage, you will also select the types of wood and the colors of the upholstery materials to be used in the furniture’s production. Once confirmed, the sales representative will send you samples of the wood and upholstery materials for your approval. Alternatively, you can come view them at the company’s headquarters in Ormož. After you approve the samples, you will receive a final sales quote specifying the price for the selected furniture.

3.1. Prices and Payments

Product prices are listed in euros (EUR). VAT is not charged pursuant to paragraph 1 of Article 94 of the Value-Added Tax Act (ZDDV-1).

Payment shall be made based on the submitted sales offer, specifically by bank transfer to the account number SI56 0400 0028 1668 056. The buyer must follow the instructions provided in the sales offer when making the payment.

Payment must be made in full as an advance payment and is a prerequisite for the start of production.

3.2. Product Delivery

Delivery within the Republic of Slovenia is included in the price of the product(s). For deliveries outside Slovenia, the delivery charge is determined on a per-order basis.

Delivery time depends on the availability of materials and is determined on a per-order basis.

3.3. Withdrawal from the Contract

In accordance with Paragraph 2 of Article 135 of the Consumer Protection Act, the buyer does not have the right to withdraw from the contract. Before deciding to make a purchase, the buyer must decide which types of wood and/or upholstery materials will be used in the manufacture of the furniture. Once the decision has been made, the buyer receives physical samples of the wood and materials for approval. Production of the ordered furniture begins only after the samples have been approved and payment has been made.

4. Ordering Process (Request a Quote)

4.1 Request for a Quote

The website www.senik.si does not offer direct online purchasing. By clicking the "Request a Quote" button, the customer submits a non-binding inquiry for the selected product.

Submitting an inquiry does not constitute a purchase or create a binding sales contract.

4.2 Consultation and Material Approval

After receiving the inquiry, Senik contacts the customer by email or telephone to discuss and confirm all product specifications.

Before production begins, Senik sends wood and cork leather samples to the customer for approval. Production starts only after the customer has confirmed the selected materials.

As the customer approves the material samples prior to production, complaints relating solely to the natural colour, texture or appearance of the approved wood or cork leather will not be accepted.

4.3 Quotation

After all specifications have been agreed and the material samples have been approved, Senik issues a quotation stating:

  • product specification;

  • purchase price;

  • production time;

  • payment terms.

The quotation becomes binding once accepted by the customer.

4.4 Advance Payment

After the customer accepts the quotation, Senik issues an advance invoice.

Production begins only after the advance payment has been received.

The advance payment covers the full production costs of the ordered product.

4.5 Production

Each product is handcrafted and manufactured individually according to the agreed specifications and the approved material samples.

4.6 Final Invoice

Upon completion of production, Senik issues the final invoice, which includes the packaging and shipping costs to the customer's chosen destination.

The production costs have already been covered by the advance payment.

4.7 Final Payment and Delivery

The customer is required to pay the outstanding balance shown on the final invoice, representing the packaging and shipping costs.

Once the outstanding balance has been received, Senik arranges shipment of the product to the agreed destination.

4.8 Cancellation

The customer may cancel the inquiry at any time before accepting the quotation.

Orders for products manufactured according to the customer's individual specifications cannot be cancelled once production has commenced.

4.9 Right of Withdrawal

The statutory right of withdrawal does not apply to products manufactured according to the customer's individual specifications or clearly personalised products.

4.10 Damaged Shipment

The customer should inspect the shipment upon delivery.

Any visible transport damage must be reported to the delivery carrier and to Senik without undue delay.

5. Warranty and Warranty Claims

No warranty or warranty claims may be asserted for any variations in colour and texture that are typical of the materials.

Damage resulting from improper or incorrect use or/and care of the products is not covered by the warranty or subject to warranty claims. Product care instructions will be delivered with each shipment.

5.1 Warranty

The manufacturer provides a one-year warranty on the products.

Pursuant to Article 97 of the Consumer Protection Act (ZvPot-1), the buyer may request the rectification of defects during the warranty period. The seller must remedy the defect within a total of 30 days from the date of receiving the request for rectification. This period may be extended by up to 15 days; the seller must notify the buyer of the duration of the extension before the 30-day period expires. The extension is influenced by the nature and complexity of the goods, the nature and severity of the nonconformity or defect, and the effort required to complete the repair or replacement.

If the seller fails to repair the product or replace it with a new one within this time, the buyer may request a full refund of the purchase price or a proportional reduction in the purchase price.

If the nonconformity occurs within 30 days of delivery of the goods, the buyer may request a refund of the amount paid.

5.2 Warranty Claims

Pursuant to Article 78 of the Consumer Protection Act (ZvPot-1), the seller is liable for any nonconformity of the goods that exists at the time of delivery and that becomes apparent within two years of delivery. Article 83 of the same Act stipulates that the buyer may not withdraw from the contract if the nonconformity is merely minor. Article 84 requires the buyer to notify the seller of the nonconformity within two months of the date on which the nonconformity was discovered. In the notice, the buyer must describe the nonconformity in detail and allow the seller to inspect the goods.

The buyer must first notify the seller of the nonconformity of the goods. Pursuant to Article 81 of the Consumer Protection Act (ZvPot-1), the buyer is entitled, under the specified conditions and in the following order, to:

  • request that the goods be brought into conformity free of charge;

  • request a price reduction proportional to the non-conformity or withdraw from the sales contract and request a refund of the amount paid.

6. Liability

Upon delivery, the buyer receives maintenance instructions and is solely responsible for the proper use and care of the products and for any damage that may result from improper use and / or care. This includes uneven exposure of the products to sunlight and the resulting uneven discoloration, exposure of the products to inappropriate cleaning agents and temperatures outside the room temperature range, and anything that is not part of the normal and foreseeable use of the product.

7. Personal Data

The scope of data collection and processing is precisely defined in SENIK’s Privacy Policy.

8. Changes to the Terms and Conditions

The Seller reserves the right to change these Terms and Conditions at any time. The current Terms and Conditions are published on the website www.senik.si.

9. Dispute Resolution

In the event of a dispute between the buyer and the seller, both parties will endeavor to resolve the dispute amicably. If this is not possible, the court in Ptuj, Slovenia shall have jurisdiction to resolve the dispute.

10. Conclusion

These Terms and Conditions are effective as of the date of their publication on the website. By confirming the order, the buyer confirms that they agree to these Terms and Conditions.
